JUL 14.1967 BOOK 6 No, 7 ,j <br />Chairman Scurlock noted that back when staff recommended we <br />not purchase Bent Pine water and wastewater system, the Board <br />directed that staff negotiate a new franchise, and over a period <br />of time and several meetings, staff has been unable until today <br />to come up with a recommendation to the Board. <br />Board members wished to see a copy of the Minutes directing <br />staff to negotiate a new franchise and were advised that it would <br />be supplied. <br />Commissioner Eggert asked the County Attorney what options, <br />if any, we have other than approval of staff's recommendations. <br />Attorney Vitunac advised that the Commission has the option <br />of giving them a different franchise than that recommended by the <br />Utility staff or the option of terminating the franchise <br />altogether for non=compliance in the past and poor prospects of <br />compliance in the future. <br />Commissioner Eggert inquired about the process required for <br />termination, and Attorney Vitunac stated that we would have to <br />schedule a public hearing and give them an opportunity to respond <br />to the specific charges against them. That actually is what this <br />is today; although our staff recommendation was to give them a <br />new franchise and allow them until September to comply. <br />Commissioner Wheeler asked why staff did not recommend <br />terminating the franchise. <br />Director Pinto explained that staff believed it would be <br />advisable to give Bent Pine the opportunity to abide by the <br />contract that we agreed to, and then if they don't wish to do <br />that, staff will make a further recommendation. <br />Commissioner Eggert believed we gave them that opportunity <br />in 1986, and Director Pinto felt staff is asking to give them <br />another opportunity. <br />Commissioner Eggert wished a more complete answer from <br />Attorney Vitunac re the Board's options. <br />Attorney Vitunac clarified that the first option is that the <br />county could take over the system by purchase or donation or some <br />46 <br />
