Attorney Vitunac asked if they have responded to the com- <br />plaints, and Mr. Chancellor advised they have had people go out <br />in the field and investigate them. <br />Attorney Vitunac then asked about fire flow, and Mr. <br />Chancellor believed it is whatever it was supposed to be. <br />Attorney Vitunac asked if there has been a transfer of <br />stock, and Mr. Chancellor said there has not. <br />Attorney Vitunac asked staff if there have been any other <br />letters of complaint, and Franchise Manager Abernethy reported <br />that we have had one letter from the Home Owners Association. <br />Attorney Vitunac, as a final closing remark, stated that he <br />felt it is important for the record to show that this county is <br />ready, willing and able to pass an order extending or modifying <br />or issuing a new franchise to that utility today as we think we <br />are required to do under the 179 Resolution, but the people who <br />we thought wanted that action taken are saying today that they <br />are not even sure they want a franchise and would prefer to be <br />unregulated. He felt it is incumbent on the County to issue them <br />some franchise anyway or put them out of business - they do not <br />have the option of operating without regulation from this county. <br />Attorney Bird was still in favor of keeping the olive branch <br />out and tabling to give them an opportunity to meet with their <br />principals and come back to the Commission as quickly as <br />possible. <br />Commissioner Eggert was confused as to what good their <br />response would do. <br />Attorney Vitunac believed the Board has to make the first <br />step and say here is your new franchise, and then in September <br />1987, if they have not complied, revoke their entire operating <br />permit at that time. <br />Attorney Eggert stated that she would like to formally <br />request that this be what they should consider as the franchise, <br />and she would be happy to move the staff recommendation.
