CHEATH <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on July9j , 1987. <br />DESCRIPTION & CONDITIONS: <br />On June 12, 1987, County staff observed that parcels number <br />20-31-39-00000-7000-00003.2 and 00003.3 had been cleared, <br />including the removal of twenty nine (29) protected red maple <br />and bay trees prior to the issuance of tree removal and landclear- <br />ing permits. The area cleared is approximately 1.5± acres in <br />size, and is located behind the Gator Lumber Company business <br />at 9555 U.S. #1. The property is zoned CH, Heavy Commercial <br />District. <br />In addition, staff observed that some ditching had occurred on <br />the property prior to the issuance of a County stormwater <br />management permit. <br />The property is owned by the Gator Lumber Company, represented <br />by Mr. L. Ray Cunningham of the 9555 U.S. #1 business location. <br />On March 23, 1987, staff received a landclearing permit applica- <br />tion from Mr. Cunningham to clear property owned by Gator <br />Lumber, behind the existing US#1 business. The application was <br />submitted on the basis that the work was to be done for snake, <br />rodent and fire hazard control. <br />The application submittal was incomplete in that a tree survey <br />of the site was not included. The applicant was subsequently <br />contacted and told that a landclearing permit would not be <br />issued until a tree survey was submitted. The tree survey was <br />never submitted, and a landclearing permit or tree removal <br />permit was never issued. <br />ALTERNATIVES & ANALYSIS: <br />Section 231-6(a) & (b), Tree Protection, of the Code of Laws <br />and Ordinances of Indian River County, Florida Prohibits the <br />performance of, any tree removal, landclearing or grubbing <br />unless tree removal and landclearing permits have first been <br />issued by the County.
