FF'_ <br />BOOK F. <br />Chairman Scurlock wished to know where the money is going to <br />come from if we accept the offer to settle, and he asked Attorney <br />Barkett if there was discussion of any terms for payment and the <br />possibility of spreading it over more than one year. <br />Attorney Barkett advised that was discussed. He was not <br />sure we could do it that way; possibly we could legally do it in <br />.two payments, but in any event, they were not amenable. <br />OMB Director Baird believed he could find a funding <br />mechanism for the $724,000 difference, but wanted the Board to <br />realize fully that buying something of this magnitude that is not <br />budgeted would have a large impact on the fund balance flowing <br />into next year. <br />Chairman Scurlock continued to discuss the possibility of <br />making one payment in this budget year and one in the next. He <br />felt possibly we could make a counter offer to that effect, <br />especially as we are only two months from the beginning of the <br />new fiscal year. <br />Discussion continued in regard to the $724,000 including <br />costs and attorney's fees, and Commissioner Bird could not under- <br />stand how two M.A.I. appraisers can be so far apart in their <br />appraisals when they are based on comparable sales. <br />Attorney Barkett stated that he had a hard time justifying <br />that much of a difference also. He noted, however, that there is <br />a lot of subjectivity in appraisals, and our appraiser determined <br />that this property is at the low end of the scale because of the <br />Coastal Construction Line and the potential of the COBRA Bill, <br />which has not been reflected in sales so far. Their appraisal <br />was at the high end in spite of those factors as they felt they <br />still would be able to develop the property to the same extent. <br />Commissioner Bird felt it actually is a toss-up and both <br />attorneys can make their case in court; we estimated $1,800 per <br />front foot, and this works out to about $2,200 per front foot. <br />Attorney Barkett tried to look at this from a juror's point <br />of view and felt they will see the county taking this person's <br />38 <br />M <br />
