Environment <br />The subject property is not within a flood prone area. However, <br />the national wetlands inventory does show a freshwater emergent <br />wetland area and a forested wetland area on the site. This site <br />would require intense review by the DER, Army Corp., and St. <br />JohnWater Management during the review of any proposed <br />deve opment, whether retail or residential. <br />Utilities <br />Currently, public utilities are not available to the site. The <br />Utilities Division does anticipate having a regional wastewater <br />plant on line in this area within two years. <br />RECOIMMENDATION <br />Based on the analysis performed, staff recommends approval. <br />ommissioner Bowman questioned the implications of this <br />emerg,nt wetland area, and Staff Planner David Nearing explained <br />that portions of the site do have some characteristics of <br />emerglInt wetlands; however, during the site plan process the <br />appii ant would have to show beyond a shadow of a doubt that this <br />land is not environmentally sensitive, or if it is, show how they <br />could',mitigate any impact. <br />Commissioner Bowman asked how you mitigate water storage <br />areas', and Director Keating advised that they would have to <br />comply with all the requirements of the County's stormwater <br />manag'ment ordinance and not create any adverse impact. <br />Chairman Scurlock pointed out that, in fact, they may not be <br />able to do that. <br />The Chairman opened the Public Hearing, and asked if anyone <br />wished to be heard in this matter. <br />Attorney Michael O'Haire, representing the applicant, <br />emphasized that the rezoning is irrelevant to the concerns <br />expressed by Commissioner Bowman. If there is a problem, it will <br />have to be addressed during the site plan process, regardless of <br />whether it is zoned multiple -family or light commercial. The <br />rezoning does not affect or aggravate the problem one way or <br />another.
