r <br />BOOK, 69 P AGE467 <br />SEP 15 1987 <br />P <br />Director Pinto informed the Board that staff went up and <br />looked at the operation going on there, and words simply can't <br />describe it. He could not believe that the DER couldn't have <br />taken stronger action. Utilities feels that the only way to <br />resolve this problem and protect the health and welfare of the <br />community is for the county to take the facility over as quickly <br />as we possibly can and make emergency repairs to assure that the <br />people have adequate and safe water. The Environmental Control <br />Board has written a Stipulation for the utility owners to sign <br />which will accomplish this. Mr. Pinto noted that we are not <br />really gaining an asset; we are agreeing to take this facility <br />over strictly because of our concern for the health and welfare <br />of the residents. We are insisting on a clear title and all <br />their back records, plans, etc., being turned over to us to give <br />us some assistance in providing the service. <br />Director Pinto continued that he is going to meet with the <br />residents of this community Thursday night. They will be <br />required to pay impact fees, both water and sewer. We are <br />probably looking at some $50-60,000 immediate expense to go in <br />and replace what they have, particularly on the water side, and <br />staff needs the Board's approval to go in and make these <br />emergency repairs as soon as all documents are signed. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously approved <br />the Stipulation, authorized the Chairman to sign <br />same after all pertinent documents are received, <br />and authorized staff to make the required emergency <br />repairs as soon as the legalities are taken care of. <br />Commissioner Bowman was concerned that this will cost us a <br />lot of money and felt strongly that the $1,000 required to be <br />paid by Keppler is not nearly enough. She noted that Keppler has <br />been fined punitive damages over the years; she did not believe <br />30 <br />
