River County has for acceptance of such systems, <br />including but not limited to the transfer of clear <br />title to the real property the systems are located <br />upon, subject to any restrictions of record, zoning <br />restrictions and similar restrictions, together with <br />any easements needed by the County at the time of <br />the transfer. <br />c. File a Notice of Dimissal in Keppler Land <br />Improvement Inc., et al vs. Indian River County <br />Environmental Control Hearing Board, et al., Case <br />#87-0844, Fourth District Court of Appeal, State of <br />Florida, within forty-eight (48) hours after formal <br />acceptance of all parties to this Stipulation. <br />d. Maintain the subject water and sewerage plants in a <br />safe and sanitary manner so as not to jeopardize the <br />environment or public health until such time as the <br />transfer described in subparagraph "b" above is <br />approved by the Indian River County Board of County <br />Commissioners. This shall include but not be <br />limited to the uninterrupted operation of the water <br />supply and sewerage system, the timely payment of <br />electric bills, and the retention of chlorine <br />residual in the finished water as required by law. <br />3. This Stipulation and any Order approving this <br />Stipulation are conditioned upon the transfer of the subject <br />water and sewerage systems and formal acceptance of same by the <br />Indian River County Board of County Commissioners on or before <br />September 29, 1987. If for any reason, including reasons beyond <br />Respondents' control, such transfer and acceptance is not <br />completed, this Stipulation and any Order adopting this <br />Stipulation shall become null and void, as if they had never been <br />entered or approved.
