ok <br />Attorney Bogosian did not feel his client would be too <br />concerned if the Board.,adopted the resolution without recording <br />it. He did feel, however, that if he was an attorney for a bank, <br />he would question why this resolution was passed if it did not <br />afford any more protection than the Tree Protection Ordinance. <br />Vice Chairman Bowman felt that the resolution gives the tree <br />added recognition and protection. <br />COMMISSIONER EGGERT MADE A MOTION that the Board adopt <br />Resolution 87-120, designating a particular Simpson <br />Stopper Tree to be a "specimen tree" in accordance with <br />Section 231-5(n) of the County Tree Protection <br />Ordinance No. 83-41, without having the designation in <br />the official record books of the County, in that the <br />specimen tree designation would not afford said <br />protected tree any additional protection under the <br />County Tree Protection Ordinance. <br />Commissioner Bird stated that he would not second the Motion <br />because he felt this Public Hearing has established the tree as a <br />special tree and made the resolution unnecessary. <br />Attorney Vitunac advised that he always felt that the <br />Chairman has the right to make a motion or second a motion in a <br />small body such as this. However, it should not be done <br />routinely. <br />VICE CHAIRMAN BOWMAN SECONDED THE MOTION, which was <br />voted on and carried by a vote of 2-1, Commissioner <br />Bird dissenting. <br />Commissioner Eggert felt very definitely that this tree <br />should have Planning Department status, which is what the <br />unrecorded resolution gives it, because this meeting may be <br />forgotten in 5 years or so. <br />41 <br />SEP 221987 <br />POCK 69.
