SEP 2 2 237 <br />BOOK 69vA 5:30 <br />Because the Gifford Dock landing has historical significance, the <br />proposed abandonment and relocation of the subject road segment <br />was reviewed by the Scenic Trails Committee on July 23, 1986. At <br />that meeting the Committee recommended that the proposal be <br />approved with the condition that the new roadway not be paved but <br />be an improved marl road (to maintain the traditional character of <br />the river landing area). <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having possible jurisdiction within the right-of-way. <br />All reviewing agencies have recommended approval of the <br />abandonment and roadway relocation request. <br />ANALYSIS: <br />The subject 15' wide right-of-way is currently improved as a marl <br />road and is graded by the County. The subject right-of-way is not <br />a part of the roadway system as noted on the County Thoroughfare <br />Plan and is not needed as part of the thoroughfare system. The <br />abandonment, in conjunction with the proposed roadway relocation, <br />would not interfere with convenient access to the Gifford Dock <br />landing or to properties south of Gifford Dock Road. --- <br />The Public Works Director has no objection to the proposal, <br />including construction of the proposed marl roadway. The County - <br />Attorney's Office has reviewed the request and the .submitted deed <br />(with reverter clause) and has found both acceptable. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners abandon <br />the County's rights to the subject portion of Gifford Dock Road, <br />accept a deed (with a reverter clause) for the subject right-of- <br />way, and authorize the Board Chairman to execute the attached <br />resolution (attachment #5). <br />Commissioner Bird asked if the 900 turn that this would <br />create would be a problem from a traffic flow standpoint, and <br />Planner Stan Boling advised that the Traffic Department has <br />addressed that situation and does not feel it would. <br />Vice Chairman Bowman opened the Public Hearing, and asked if <br />" v <br />anyone wished to be heard in this matter. <br />Attorney Steve Henderson, representing Grand Harbor, Inc., <br />stated he was here to answer any questions concerning the <br />- legalities of this deed exchange. <br />46 <br />
