EOGK 69 MME 622 <br />Since the building department's inspection of the footers on July <br />5, 1985, there is no evidence that a good faith effort to proceed <br />with completion of the project has occurred in the last 27 months, <br />as per section 23.1(g)(3). By terminating the project, the County <br />can ensure that the site is developed according to current County <br />and State regulations. <br />Termination of the existing site plan would require a developer to <br />submit a site plan application in conformance with the County's <br />current codes and policies to develop the site. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners terminate <br />the approved site plan (File SP -MA -83-07-079 to construct a <br />shopping center at South U.S. 1. <br />Planner Boling summarized that the building permit has been <br />extended for a total of 27 months without any work being <br />performed, and there have been many change in county regulations, <br />permits requirements, etc., during that time. There are two <br />things the Board has to find this morning to justify termination. <br />1) That an active building permit has not been maintained. <br />2) That there has not been a good faith effort to proceed with <br />completion and no activity on the site for a continuous period of <br />6 months. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously (4-0) <br />terminated the South Vero Square Site Plan for the <br />reasons stated above. <br />ANNOUNCEMENT RE DHRS SECRETARY <br />Commissioner Eggert wished to make a statement for the <br />Press.
