_9/1/87.1(Legal)Agree2(� <br />A G R E E M E N T <br />THIS AGREEMENT, made this Z Z day of , <br />1987, by and between STATE OF -=IDA DEPARTIVENT <br />AGRICULTURE AND CONSUMER SERVICES, Room 1003, The Capitol, <br />Tallahassee, FL 32301, (904) 488-9790 (DEPARTMENT), and <br />INDIAN RIVER COUNTY, apolitical subdivision .of the State of <br />Florida, 1840 25th Street, Vero Beach, FL 32960, (305) <br />567-8000 (COUNTY), <br />W I T N E S S E T H: <br />WHEREAS, §125.01(1)(f) and §125.01(1)(w), Florida <br />Statutes, provide that the COUNTY shall have the power to <br />provide recreation and cultural facilities and programs and <br />perform any acts not inconsistent with law which acts are in <br />the common interests of the people of the COUNTY; and <br />WHEREAS, Chapter 616, Florida Statutes, provides <br />for the holding of county fairs which serve an entire county <br />and the exhibits of which are in accordance with §616.17 in <br />which premiums or awards are given to exhibitors of the <br />fair; and <br />WHEREAS, Chapter 616, F.S., provides that a county <br />fair may be run by an association not-for-profit formed for <br />the purposes of giving a county fair; and <br />WHEREAS, in Indian River County the Board of <br />County Commissioners itself wishes to own and operate a <br />permanent county -fair facility under control of the Board; <br />and <br />WHEREAS, the Board wishes to have its county fair <br />authorized by the state as if it were run by a fair <br />corporation as defined in Chapter 616; and <br />WHEREAS, the COUNTY believes that a fair under the <br />control of the Board of County Commissioners will be more in <br />the public interest than one operated by a private <br />corporation since the Board has the administrative and legal <br />controls in place already to efficiently and legally provide <br />a top-quality county fair with proper audit controls and <br />accountability for cash income and expenses; <br />NOW, THEREFORE, the DEPARTMENT and the COUNTY <br />agree as follows: <br />1. The COUNTY shall be authorized to present an <br />annual county fair in compliance with §616.17 and in which <br />premiums or awards are given to exhibitors of the fair. <br />The fair shall be given for the benefit and development of <br />the educational, agricultural, horticultural, livestock, and <br />other resources of the COUNTY. Agricultural products shall <br />be typical of those produced in the county. <br />2. As far as is legally possible, the COUNTY <br />shall comply with all requirements of Chapter 616 relating <br />to the holding of a county fair and shall comply with the <br />rules and regulations adopted by the DEPARTMENT for county <br />fairs. <br />3. The DEPARTMENT reserves the right to inspect <br />and audit the fair as if it were a fair given under Chapter <br />616, Florida Statutes. In particular the COUNTY agrees that <br />it will cooperate with the DEPARTMENT in performing audits <br />of the financial affairs concerning the fair and shall <br />comply with suggestions and recommendations of the <br />DEPARTMENT to improve financial and fiscal controls at the <br />fair with the result that all income and expenses of the <br />fair are properly accounted for. <br />OCT o ���� Ruols 69 F'Nu '759 <br />1 <br />
