� r � <br />The only alternative as per Chapter 77-165 of the Legislature of the State <br />of Florida is to approve the execution of the agreements and adoption of <br />the authorizing resolution. <br />R CKME DATIONS AND FUNDING <br />Based upon mandate by Florida Legislature, Chapter 77-165, it is <br />recommended that the County accept transfer of the CR512 crossing, that the <br />authorizing resolution be approved, and that the Chairman execute the <br />agreement. <br />Commissioner Bird questioned the reason that the corre- <br />spondence on this request goes all the way back to 1983, and <br />Director Davis explained that he sent this request to a former <br />County Attorney and it got misplaced in the files. The F.E.C. <br />Railway called about two months ago to see what happened, and <br />staff tracked it down. <br />Commissioner Bird wished to know, when we accept a crossing <br />such as this from the F.E.C., whether we have the right to expect <br />them to bring it up to some standards before we accept it. <br />Director Davis advised that the F.E.C. informed us several <br />years ago that they were going to rebuild the crossing and bill <br />the county, but we looked into our records and found we did not <br />have the transfer giving us jurisdiction; so, we sent the bill to <br />the D.O.T., who refused to pay it, and it went back and forth for <br />some time. The crossing has been rebuilt in the meantime, and he <br />believed the D.O.T. did pay. <br />ON MOTION by Commissioner Bird, SECONDED by Com- <br />missioner Wheeler, the Board unanimously adopted <br />Resolution 87-138 approving the License Agreement <br />accepting the transfer of the CR512 railroad <br />crossing. <br />87 13 Boos 70 Pac£ 50 <br />
