NOV 2 41 28 <br />Boob 76 F 1.56 <br />Chairman Scurlock believed we must realize that as the <br />impact fees are escalated to take care of the additional R/W, we <br />will have less and less R/W donated, and we, therefore, must <br />accept that we are going to hay.e to pay for R/W. <br />Commissioner Bird did not question that, but just felt the <br />word may be getting.out that if you negotiate with'the county, <br />you can get the appraised value plus the expenses we would pay if <br />we went to court, and he felt possibly we should challenge a few <br />of these so it doesn't seem we are setting a pattern. <br />Attorney Vitunac did not feel we will have this problem in <br />the future very much because of the change in state law that <br />allows us to make an offer of judgment and we pay attorney's fees <br />only up to that point. He believed on a property of this size <br />and price, however, they could very well win in court. Attorney <br />Vitunac assured the Board that in the future we will have an <br />aggressive negotiating policy and contest valuations, but staff <br />all concur this is the best way to settle this particular parcel. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />M. Quitclaim Deeds for 47th St. R/Ws <br />The Board reviewed memo of Assistant County Attorney <br />Brennan: <br />TO: The Board of County Commissioners <br />FROM: Sharon Phillips Brennan 'qP6 <br />Assistant County Attorney <br />DATE: November 18, 1987 <br />SUBJECT: Quitclaim Deeds for 47th Street Rights -Of -Way <br />Execution of these deeds is a necessary step to rectify <br />placement of the County's road right-of-way on 47th Street. <br />The right-of-way is presently described as lying north of <br />the quarter line, and it should correctly be placed south of <br />the quarter line. <br />By arrangement with the adjacent property owners, the County <br />will deed the described property to them and in return, they <br />will deed the required right-of-way to the County. <br />14 <br />
