ABERNETHY <br />FRANCHISE MANAGER <br />SUBJECT: TRANSFER OF OWNERSHIP AND ASSIGNMENT OF FRANCHISE <br />FROM SOUTHEAST WATER AND SEWER COMPANY TO 1400 <br />DEVELOPMENT CORPORATION <br />BACKGROUND <br />Southeast. Water and Sewer Company, also known as Grove Isle <br />Development Corporation, recently submitted application and review <br />fee, as required by Resolution 85-67,•for the transfer of Ownership <br />of the Southeast Water and Sewer Company franchise to 1400 <br />Development Corporation. Attached hereto are the Company's financial <br />statements, certificate of responsibility, Article of -Incorporation, <br />and Department of Environmental Regulation_ operations permit. <br />XVTAT VCTC - - <br />Staff has reviewed the supporting documents and upon several <br />occasions has met with the representatives for both parties, Sean <br />O'Haire, Esquire and Ms. Saundra Morgan. Staff agrees and accepts <br />the transfer from Southeast Water and Sewer Company to 1400 <br />Development Corporation. <br />RECOMMENDATION <br />The proposed Resolution, accepted by 1400 Development Corporation and <br />attached hereto, will replace Resolution 85-67. This new Resolution <br />will bring the franchise up to current standards which are regulated <br />by the Division of Utility Services Franchise Administration <br />Department. <br />At this time, Staff recommends and requests that the Board of County <br />Commissioners approve the transfer of ownership by authorizing- the <br />Chairman to sign the foregoing Resolution. <br />Mrs. Abernethy advised the Board that Southeast Water and <br />Sewer Company has brought the franchise back into compliance and <br />it now conforms to current standards. <br />Chairman Scurlock wished to know if the Commission agrees <br />with the current franchise that our Utilities Department is <br />-recommending. We have had some controversy lately in this <br />regard,.and he felt it is important at this time for the <br />-Commission to address the franchises themselves and make it clear <br />just what our policy is re the utilities that exist today.
