Miller Mtn REFERENCES: DREDGE & FILL/MISC2 <br />Chief Environmental Planning & <br />Code Enforcement <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners_ at their <br />regular meeting of December 8, 1987. <br />DESCRIPTIONS AND CONDITIONS: <br />The DER routinely solicits comments from local governments during <br />their permit review process and considers comments from local <br />governments in acting on dredge and fill permit applications. <br />Typically, the staff responds to DER on small scale --projects, when <br />the .comments are technical - but- not negative. :=Such staff level <br />comments are not generally brought to the attention of the Board <br />of County Commissioners.- The subject dredge and fill application, <br />however, concerns the filling of 16 acres of submerged <br />bottomlands, and has the potential to seriously impact the lagoon. <br />Therefore, the staff recommends that the Board review the <br />information contained herein and authorize comments to be sent to <br />DER. <br />The project is located in the Indian River Lagoon, 1.6 miles south <br />of the Sebastian Inlet, to the west of Highway AIA (Section 28, <br />Township 30 South, Range 39 East). The proposed project is <br />located within the unincorporated portion of the County. Although <br />most area seaward of mean high water is under state ownership, <br />certain submerged bottomland is privately owned. The subject <br />property constitutes some of that privately owned bottomland. <br />The applicant has applied for a dredge and fill permit from the <br />Florida Department of Environmental Regulation (DER} A dredge <br />and fill permit from DER is necessary prior to any filling of <br />submerged bottomlands in the Indian River Lagoon. The applicant _ <br />proposes to fill an area of approximately 16 acres that is <br />currently below the mean high water line, in order to develop a <br />residential subdivision. <br />If the State issues the dredge and fill permit, the applicant will <br />file with the County for subdivision approval, and the County will <br />apply County requirements during the subdivision review process. <br />The applicant intends to construct 16 single-family lots of <br />approximately one acre each. Water and sewer service would be <br />provided by individual well and septic tank, and stormwater runoff <br />will be detained on-site and discharged to the lagoon. A concrete <br />seawall will be constructed at the perimeter of the project, and <br />docking facilities are proposed. <br />ALTERNATIVES AND ANALYSIS: <br />The Planning and Development Division reviews and submits comments <br />on dredge and fill applications to the permitting agencies based <br />upon the following: <br />The Conservation & Coastal Zone Management Element of the <br />Indian River Comprehensive Plan <br />DEC 8 1987 <br />7 BOOK 70 F,gGF 254 <br />
