to the beach club as proposed, especially with the additional <br />wording suggested by Mr. Bird. <br />It was determined that no one else wished to be heard, and <br />the Chairman thereupon declared the public hearing closed. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Bird, that the Board approve staff's <br />recommendation with the additional condition proposed <br />by Commissioner Bird, i.e., that prior to C.O., the <br />applicant through a set of recorded and county <br />approved membership documents will provide evidence <br />that transient use of club facilities will not occur, <br />such evidence may include but not be limited to price <br />of the membership, residential membership qualifica- <br />tions, membership time frames, and other requirements. <br />In discussion, it was felt because of the hotel, the <br />definition of "transient" could cause a problem, and Commissioner <br />Eggert asked if we could just state that the membership is <br />limited to the total units of Grand Harbor, Bay Tree and The <br />Shores. <br />The Chairman did not have any problem with that but had some <br />questions about a resident bringing a guest, for instance, and <br />how you would monitor that situation. He believed, however, that <br />trying to regulate and allow for every possibility would be the <br />same as being a Director of the club. <br />Mr. Schaub brought up the point that it is customary in fine <br />clubs throughout the United States to make provision for some <br />honorary memberships for the clergy and people of that sort, and <br />he does not feel that should be shut out from this club. <br />Commissioner Bird clarified that the whole purpose of his <br />proposed addition was just to put something on the record that <br />years from now would indicate the use was approved under the <br />concept that it is a private club and an amenity for the use of <br />77 ROOK 70 PAGE394 <br />
