DEC <br />Boa <br />70 FAGF 468 <br />Mr. <br />Schopke assured the Board that he has done <br />everything he <br />can short of holding a gun to the sub -contractor's head, and he <br />certainly would never use them again. <br />Commissioner Wheeler believed that at this point Option 2 <br />would seem the most logical. <br />Chairman Scurlock agreed that hopefully Option 2 would get <br />the job complete, but if it shouldn't, he wanted to be very sure <br />that we do not lose any of our other options. <br />Attorney Vitunac assured the Chairman that by choosing <br />Option.2, we would not be waiving any other rights we might have. <br />Administrator Balczun, on being asked for staff's opinion, <br />also recommended Option 2; although, he felt none of the options <br />are very good. <br />Commissioner Bird noted we have been given a date of <br />completion of January 5th, and he wanted to be sure that whatever <br />site work we are responsible for will be completed by then. <br />Mr. Dean confirmed that will be done, but continued that one <br />area that must be addressed by Schopke is the vinyl flooring in <br />the jail. Some of it must come up and be replaced. <br />Mr. Schopke was not sure it must be replaced and reported <br />that they have the national representative coming down to look at <br />it on Thursday. There are some bubbles and possibly the glue was <br />bad. <br />Mr. Disney stated that he will review the recommendation of <br />the floor manufacturer, but at this point, we do not have a floor <br />that is acceptable. <br />ON MOTION by Commissioner Wheeler, SECONDED by Com- <br />missioner Bowman, the Board unanimously (4-0) approved <br />Option 2 as recommended by Frizzell Architects, i.e., <br />simply wait for Schopke to finish the project at a con- <br />tinuing penalty of $250 a day. <br />88 <br />
