TO FALCON CABLE MEDIA <br />BACKGROUND <br />Jones Intercable recently submitted application and review fee, as <br />required by Ordinance 82-7, for the Transfer of Ownership of the <br />Cable TV franchise to Falcon Cable Media, Limited Partnership. <br />Attached hereto is a brief overview of the Company's philosophy in <br />management and business including financial statements, service <br />locations, letters of recommendation from several financial <br />institutions, and letters of recommendation from various <br />municipalities throughout the United States that are serviced by <br />Falcon Cable Media, L.P. <br />ANALYSIS <br />Staff has reviewed the supporting documents and upon several <br />occasions has met with the representative from both parties. After <br />careful consideration staff agrees and accepts the transfer from <br />Jones Intercable, Inc., to Falcon Cable Media, L.P., by Resolution <br />attached hereto and by an Agreement, attached hereto, providing for <br />certain changes to Ordinance 82-7. <br />RECOMMENDATION <br />Staff recommends and requests that the Board of County Commissioners <br />approve the transfer of ownership and the assignment of franchise to <br />Falcon Cable Media, Limited Partnership by authorizing the Chairman <br />to sign the foregoing Resolution. <br />Further, staff recommends and requests that the Board of County <br />Commissioners approve the attached agreement. These changes have <br />been discussed and agreed to by Falcon Cable Media, L.P. The <br />Agreement shall bind Falcon Cable Media to the modification of the <br />rules and regulations setforth in Ordinance 82-7, until such time as <br />Ordinance 82-7 is amended. <br />Chairman Scurlock asked if modification of the franchise <br />ordinance can be done by Resolution, and Attorney Vitunac advised <br />that the second item is not an ordinance modification; it is an <br />agreement saying we will proceed with that ordinance modification <br />after we advertise it. <br />11 <br />BOOK 70 PACE 548 <br />,JAhl 1 2 1288 - Ai <br />
