Nearing e4 �CCQ <br />FROM: Staff Planner, Long-RangEPllnES: <br />REPEAL AND RECREATION OF <br />THE HOME OCCUPATION SEC- <br />TION OF THE ROSE -4 ZONING <br />DISTRICT REGULATIONS, AND <br />PROVISION FOR THE GRAND- <br />FATHERING OF QUALIFIED <br />EXISTING BUSINESSES <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of January 19, 1988. <br />DESCRIPTION & CONDITIONS <br />This is a County initiated request to amend the Home Occupation <br />provisions of Section 15. ROSE -4: Roseland Residential District <br />of Appendix A of the Zoning Code. These provisions currently <br />permit specific home occupation uses within the ROSE -4 District <br />which are not permitted in other residential districts of the <br />County. Further, it is the intent of this request to establish <br />specific criteria which will permit certain existing businesses <br />to continue operating as nonconforming uses. These businesses <br />will be governed under Section 25 (J), nonconformities, of the <br />General Provisions section of the Zoning Code. <br />On February 24, 1987, the Board of County Commissioners voted <br />unanimously to approve Ordinance #87-22 which amended the Rose -4 <br />Zoning District. This amendment permitted a broader range of <br />home occupations in the ROSE -4 District than allowed in all other <br />residential districts. Although approved by the Board of County <br />Commissioners, the special home occupation provisions for the <br />Rose -4 district were opposed by both the staff and the Planning <br />and Zoning Commission. The additional occupations permitted <br />under this amendment are as follows: <br />a. Metal working and casting; <br />b. Contractor's office and storage of contractors materials, <br />tools and equipment; <br />c. Lawn mower and small engine sales, service and repair; <br />d. Service businesses (provided there shall be no more than <br />one sign advertising the same not in excess of four <br />square feet in size). <br />Also incorporated within that amendment were specific criteria <br />with which any proposed home occupation use would have to comply. <br />These are as follows: <br />The activity is conducted only by <br />living within the residence; <br />Products are not offered for sale <br />and from the premises except <br />provided; <br />Any evidence of the occupation <br />street by type A screening; <br />Traffic is not generated in excess <br />residential uses; <br />The property has <br />be qualified) for <br />purposes; and <br />All home occupation <br />requirements. <br />members of the family <br />to the general public <br />as herein otherwise <br />is screened from the <br />of that customary for <br />been qualified for (and continues to <br />homestead exemption for ad valorem tax <br />JAN 19 1988 <br />activities must <br />meet yard setback <br />41 <br />BOOK 70 f v,E. 601 <br />
