Re�at' g, SUBJECT: <br />Community Deve opme Director <br />THROUGH: Stan Boling 46 <br />Chief, Current Development <br />FROM: Robert E. wieg ers"-(Ai REFERENCES: subord <br />BWIEG <br />AMENDMENTS TO THE COUNTY <br />SUBDIVISION ORDINANCE <br />Staff Planner <br />It is requested that the data herein presented be given formal <br />consideration. by the Board of County Commissioners at their <br />regular meeting of January 19, 1988. <br />DESCRIPTION AND CONDITIONS: <br />In July of this year the Utilities Department requested that <br />language be placed on final plats that would guarantee future <br />hook-ups to the County's expanding utilities services. Also, <br />staff is revising the County's Subdivision Ordinance to reflect <br />recent changes in state law (Florida Statutes) concerning prior <br />property restrictions that may affect the ownership or use of <br />platted lots. Other minor alterations have been made to these <br />sections in terms of code organization. <br />ANALYSIS: <br />1. Section 1 <br />This section gives the Utilities Department the authority to <br />require that a final plat applicant file a covenant document, <br />with the final plat, that provides for future connection to <br />county water/wastewater service with all associated fees <br />paid by the subdivision homeowners' association or by indivi- <br />dual property owners of that subdivision. The proposed <br />amendment also requires thatall deeds conveying properties <br />within the subdivision reference the covenant document. <br />2. Section 2 <br />Earlier this year the Florida Legislature amended Section <br />177.091, Florida Statutes to require that plats for recording <br />include a notice of possible additional restrictions which <br />may affect the ownership of property, within a platted <br />subdivision. The proposed amendment to the existing subdivi- <br />sion ordinance precisely implements this new State <br />requirement. The other notice referenced in this section <br />concerning the placement of construction, trees, or shrubs in <br />an existing easement, currently exists within the ordinance. <br />The proposed change is intended to have this restriction more <br />prominently displayed on the final plat. <br />The County Attorney's office has verified that the proposed <br />ordinance is acceptable as to form and legal sufficiency. At <br />their regular meeting of December 10, 1987 the Planning & Zoning <br />Commission recommended that the Board of County Commissioners <br />adopt the proposed subdivision ordinance amendments. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt the <br />proposed subdivision ordinance amendments. <br />70 <br />
