The purpose of this letter <br />is to confirm to you (and by copy of this letter to the Board <br />of County Commissioners of Indian River County to also <br />confirm to them) that the present owners of all of the land <br />lying within the boundaries of the Town of Orchid are happy <br />to undertake the following: <br />1. At such time as the present land owners commence <br />development of the lands within the Town of Orchid which <br />requires water and wastewater services, then said property <br />owners and the Town of Orchid would intend to look first to <br />Indian River County to provide these services and would enter <br />into good faith negotiations with Indian River County to <br />finalize such agreements as are necessary with regard to the <br />acquisition of such services from Indian River County. <br />2. If at the time of such development Indian River <br />County is not in a posture to provide water and wastewater <br />services and facilities then, obviously, the right to obtain <br />those services from other sources would have to be reserved. <br />merely yours, <br />Darrell Fennell <br />Mr. McQueen informed the Board that his client, the Richard <br />Roberts group, is prepared to give the Board a letter similar to <br />the above, and he would like the Board to reconsider their vote <br />two weeks ago and not ask the legislature to abolish the Town. <br />Commissioner Bowman asked about the height limit in the <br />Town. <br />Mr. McQueen believed it is 45' and he felt that goes to the <br />top of the building.
