Heath Enforcement Officer REFERENCES: <br />Gifford R/E <br />DISK:REMS <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of February 2, 1988. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Charles and Janice Gifford, <br />owners of the subject property, for release of a portion of the <br />southeasterly twenty-five (25) foot utility and drainage ease- <br />ment, being the northwesterly five (5) feet of the southwesterly <br />twenty-five (25) feet of Lot 11, Roseland Pines Subdivision, <br />Section 22, Township 30, Range 38, Indian River County, Florida; <br />according to the Plat thereof as recorded in the Official Record <br />Book 703, Page 2671. It is Mr. & Mrs. Gifford's'intention to <br />construct a single-family residence on the subject property. <br />The current zoning classification is RS -1, Single -Family Residen- <br />tial District. The land use designation is LD -1, Low Density <br />Residential, one (1) unit per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell Telephone, Florida <br />Power and Light Company, Jones Intercable Corporation, and the <br />Indian. River County Utility and Right -of -Way Departments. Based <br />upon their review, there were no objections to the release of the <br />five (5) foot portion of the utility and drainage easement. The <br />zoning staff analysis showed that the drainage would be adequate- <br />ly handled on the site. <br />RECOMMENDATION: <br />Staff recommends to the Board, through the adoption of a resolu- <br />tion, the release of the northwesterly five (5) feet ofthe <br />southeasterly twenty-five (25) foot drainage and utility easement <br />of Lot 11, Roseland Pines Subdivision, as recorded in Plat Book <br />10, Page 24, of the Public Records of Indian River County, <br />Florida. <br />FEB 219 <br />• <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously adopted <br />Resolution 88-8 releasing easements in Roseland Pine <br />Subdv., as requested by Charles and Janice Gifford. <br />• <br />BOOK <br />70 <br />ACE 7.38 <br />
