Commissioner Bowman asked Mr. Kennedy if he did not know <br />when he acquired this property by swap that it was a non- <br />conforming use in a residential area. <br />Mr. Kennedy stated that he did not. He stressed that he is <br />a bona fide agricultural operator and acquired the land from <br />another bona fide argicultural use, the Ryall family, and never <br />checked on the zoning. When the question of the zoning did <br />arise, the Ryalls stated that they never knew it was rezoned, and <br />they had never asked for it to be rezoned. <br />Commissioner Bird noted that since we do have certain rules <br />and regulations that apply to agriculturally zoned lands as well <br />as residential, and we do want to encourage agriculture to <br />continue to operate, and if feasible, to expand, he believed that <br />in the future we need to be sure bona fide agricultural uses are <br />actually zoned agricultural. If at some time in the future, it <br />appears they should be converted to some other use, we should <br />change the zoning at that time. <br />Commissioner Bowman felt Mr. Kennedy should have hired Mr. <br />Cooksey back when they acquired this property, and Attorney <br />Cooksey advised that actually they did, but nobody thought to <br />check on the zoning because it had been an agricultural use for <br />so long. <br />Harvey Daniels, 9355 Frangipani Drive, stated that he had <br />nothing against Mr. Kennedy, but wished to know if Mr. Kennedy <br />has the right to cut down oak trees, especially since the oak <br />trees he cut down were not on Kennedy's property and did not <br />interfere with the tangerines he planted. Mr. Daniels informed <br />the Board that he had three oaks cut down in the back of his <br />place and three palm trees and he believed some were on the <br />easement.
