NOISE COMPLAINTS BY AGOSTINO S. LEO REGARDING RIVERWALK SHOPPING <br />CENTER AND WINN DIXIE SUPERMARKET <br />The Board reviewed the following memo dated 2/15/88: <br />TO: Board of County Commissioners DATE: February 15, 1988 FILE: <br />SUBJECT: <br />FROM: Charles P. Balczun REFERENCES: <br />County Administrator <br />NOISE COMPLAINTS - <br />RIVERWALK SHOPPING CENTER <br />AND WINN DIXIE - <br />AGOSTINO S. LEO, <br />7641 133rd Sq., SEBASTIAN <br />BACKGROUND <br />For a considerable period -of time, Mr. Agostino S. Leo of Roseland has been <br />experiencing what he terms a 'nuisance' arising from: <br />RIVERWALK SHOPPING CENTER <br />High noise levels resulting from cleaning of parking lot <br />during extreme early morning hours. <br />High noise levels emitted by lift station on this property. <br />.. WINN-DIXIE SUPERMARKET <br />High noise levels resulting from cleaning of parking lot <br />during early morning hours. <br />Mr. Leo met with me on August 21, 1987 for the purpose of bringing his <br />complaint to my attention and to request our assistance in abating this <br />nuisance. At that time, I advised Mr. Leo that our options in terms of <br />abatement were extremely limited since we do not regulate noise levels <br />emitted by either parking lot cleaners or lift stations. <br />However, I did inform Mr. Leo that we would make every reasonable effort to <br />cause Riverwalk and Winn-Dixie to be 'good neighbors'. <br />Staff was successful in negotiating a change in parking lot cleaning hours <br />at the Riverwalk Shopping Center from approximately 1:00 a.m. - 4:00 a.m. <br />to a starting time of approximately 7:00 a.m. This change has given Mr. <br />Leo and his neighbors some limited relief. <br />Unfortunately, we were not able to convince Riverwalk Shopping Center to <br />reduce the noise emitted by the lift station or otherwise shield this <br />facility. Likewise, we were not able to convince Winn-Dixie management to <br />alter parking lot cleaning hours. <br />Consequently, Mr. Leo and reportedly his neighbors continue to experience <br />bothersome noises and noise levels, particularly during early morning hours <br />(intermittently around the clock from the lift station). <br />Mr. Leo has requested that I place him on your agenda so he can bring his <br />neighborhood problems directly to you and request your assistance. <br />For your information, the following documentation is attached: <br />23 <br />FEB, 2 3 1988 <br />BOOK 71 ['AGE 23 <br />
