Attorney Vitunac advised that State law protects Mr. Agostino's <br />rights, but he would have to hire an attorney and file a nuisance <br />action in court. It is not the County's obligation to solve all <br />urban problems. <br />Mr. Agostino interjected that he does not have any money to <br />get a lawyer, and felt that is what the County is for because he <br />pays his taxes. <br />Attorney Vitunac said he would be glad to show Mr. Agostino <br />chapter and verse where State law protects his rights, but his <br />only recourse is to get a lawyer and file a nuisance action. He <br />advised Mr. Agostino to get together with the 20 people who <br />signed the protest and share the cost of hiring an attorney to go <br />into court, make a case, and get specific action against the <br />shopping center. That way he would not have to wait 6 months for <br />the County to pass an ordinance restricting certain types of <br />cleaning equipment for the parking lot. <br />Commissioner Bird wasn't sure we could develop an ordinance <br />that would be broad enough to cover all these cases and yet be <br />definitive enough to actually enforce it. He realized that we <br />have had a variety of these cases, but felt we have been fairly <br />successful in dealing with them on an individual basis. <br />Commissioner Wheeler felt the time involved in those cases <br />has been quite extensive, and he would like to see us have <br />something a deputy could use when answering a call on a noise or <br />nuisance complaint, especially during the hours of 10:00 p.m. and <br />6:00 a.m. <br />1FU 23 198 <br />28 <br />BOOK 11 FAGE 28. <br />
