ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bowman, the Board unanimously authorized <br />accepting the settlement proposal on the Green <br />property in the net amount of $4,692.50 as recom- <br />mended by staff. <br />Commissioner Bird inquired if Attorney Vitunac had reviewed <br />the figures in regard to the attorneys' fees and determined <br />whether he felt the costs set out are reasonable. <br />Administrator Balczun explained staff looks at them with a <br />view to what the court costs are going to be, but Commissioner <br />Bird stated that he would feel more comfortable if Attorney <br />Vitunac was also looking at some of these. <br />Attorney Vitunac confirmed they always look at the amount. <br />He had no problem with the numbers presented and noted that if he <br />had felt they were out of line, he would bring it to the <br />Administrator's attention. <br />JAIL - PHASE II, ARCHITECTS' REQUEST FOR ADDITIONAL COMPENSATION <br />Owners' Authorized Representative "Sonny" Dean reviewed the <br />following: <br />TO: <br />COUNTY ADMINI TRATOR <br />CHARLES P. DEAN <br />OWNERS AU ORI ED REPRESENTATIVE <br />DATE: FEBRUARY 18, 1988 <br />SUBJECT: INDIAN RIVER COUNTY JAIL -PHASE II <br />ARCHITECTS' REQUEST FOR ADDITIONAL COMPENSATION <br />W. R. Frizzell, Architects, have requested payment of $20,114.41 for <br />additional services incurred due to the general contractor not <br />completing the subject project on time. <br />In accordance with the County Attorney's opinion, the charges are <br />justified as defined under paragraph 6.1.3 of the contract documents. <br />Since the contractor was the cause of the delay of completion, it is <br />recommended that the $20,114.41 be deducted from the general <br />contractor's retainage. <br />CWR .� 1988 <br />44 <br />BOOK FaGc.14 <br />
