Balczun DATE: March 3, 1988 FILE: <br />County Administrator <br />DIVISION HEAD CONCURRENCE: <br />-- �,�.% JULY 1987 COMPREHENSIVE <br />Ro ert'fM Keat ng AI' SUBJECT: PLAN AMENDMENT APPLICATIONS <br />Community Develop ent Director <br />THRU: Gary Schindler %l <br />Chief, Long-Range <br />��..Planning <br />oolann� <br />FROM: staff Plannevid r, <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of March 15, 1988. <br />DESCRIPTION & CONDITIONS <br />The Community Development Division received two Comprehensive <br />Plan amendment applications in July of 1987 and initiated ten <br />amendment applications, three at the request of the Public Works <br />Division. <br />The staff has reviewed these amendment applications and made <br />recommendations to the Planning and Zoning Commission which, <br />sitting as the Local Planning Agency, held public hearings on <br />September 10, 1987, to consider making recommendations on the <br />proposed amendments to the County's Comprehensive Plan. <br />In 1986, the State Legislature revised the local government <br />Comprehensive Plan amendment procedure. The process now requires <br />the first public hearing by the Board of County Commissioners to <br />be held prior to the transmittal of each request to the State <br />Department of Community Affairs (DCA) for a mandatory ninety -day <br />review period. At that public hearing, the Board has the <br />option of transmitting or not transmitting any or all of the <br />proposed amendments to the State for review. Failure to <br />authorize transmittal of any proposed amendment constitutes <br />denial of that request; however, transmittal of an application <br />does not indicate Board approval of the request. <br />On October 27, 1987, the Board of County Commissioners reviewed <br />these requests for consideration to transmit each request to the <br />DCA for review. The Board approved 8 of the 10 for transmittal. <br />Denying transmittal of two of the 10 requests constituted an <br />automatic denial of these requests and the concurrent rezoning <br />requests which accompanied them. <br />All the comments from DCA have been received. The Board of <br />County Commissioners must now consider the proposed amendments <br />for final action. At the close of these final hearings, the <br />Board may adopt all, part of, or none of the proposed amendments <br />to the Comprehensive Plan. The attached flow chart illustrates <br />the Comprehensive Plan Amendment process as amended by the 1986 <br />state planning legislation. <br />In order to approve each request it will be necessary for the <br />Board of vote on each of the Comprehensive Plan amendment <br />applications individually.
