Bonding -Out for Grand Harbor Estuarine System Improvements <br />The Board reviewed the following memo dated 3/14/88: <br />TO: Charles Balczun DATE: March 14, 1988 <br />County Administrator <br />DIVISION HEAD CONCURRENCE: <br />FILE: <br />40:1" <br />e4 BONDIN-OUT FOR ND <br />ng CP SUBJECT: HARBORGESTUARIINEGSYSTEM <br />Community Dev lopm nt Director IMPROVEMENTS <br />Robert M. <br />FROM: Stan Boling4 I REFERENCES: gh estuarine <br />Chief, Current Development STAN2 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of March 22, 1988. <br />DESCRIPTION AND CONDITIONS: <br />A major component of the Grand Harbor development order (D.O.), <br />which granted D.R.I. approval for the project, was the development <br />and improvement of created and altered estuarine wetlands along <br />the eastern one-third of the site (see attachment #1). <br />Originally, the D.O. required Grand Harbor to complete the <br />estuarine system prior to the issuance of any C.O.'s for any <br />portion of the project. Recently, the D.O. was amended by action <br />of the Board of County Commissioners (see attachment #2) to allow <br />for the issuance of C.O.'s for up to 600 units if: <br />1. the developer contracts with the County to complete required <br />estuarine system improvements by January 1, 1989; and <br />2. the developer posts acceptable surety with the County to <br />guarantee the construction contract. <br />The developer, Grand Harbor, Inc., is requesting approval of a <br />construction contract, and has now submitted: <br />a) a certified cost estimate specifying remaining improvements <br />and costs of such improvements; <br />b) a contract for constructing required improvements by <br />September 30, 1988; and <br />c) three letters of credit representing 115% of the total cost <br />of remaining improvements. <br />ANALYSIS: <br />The submitted contract and letters of credit meet all applicable <br />D.O. requirements. Thus, if approved by the Board, the "bonding - <br />out" for estuarine improvements will allow a limited number of <br />C.O.'s to be issued for units within Grand Harbor. <br />Staff has periodically inspected the project site and has accepted <br />the submitted certified cost estimate for remaining estuarine <br />work. The County Attorney's office and staff have accepted the <br />submitted contract and letters of credit. The contract specifies <br />that all required estuarine system improvements (pesticide soils <br />removal, earthwork and grading, and planting) will be completed by <br />September 30, 1988. It should be noted that estuarine system <br />monitoring requirements are covered by the D.E.R. permit issued <br />for the project (permit #311043029). <br />15 <br />AR 2 2 1988 <br />BOOK 71 FAH 313 <br />
