Attorney O'Haire,contended that it would be too difficult to <br />track down everyone involved, but it was noted there are tax <br />records and the mortgagor obviously must have a list of those who <br />are paying for their properties. <br />Chairman Scurlock did not see the County getting into a <br />situation where we say we are now going to legitimize such <br />situations for every fly-by-night developer who created them. <br />He asked if the church is planning to build on this property. <br />Attorney O'Haire advised that they had contracted to sell <br />the property to an individual who went in for a building permit <br />and was told he couldn't get one, and that contract is still <br />outstanding. <br />Discussion continued at length as to any possible alterna- <br />tives, the number of ways this property is in violation of the <br />ordinance, what the Board's latitude is in granting such a <br />waiver, etc., and Chief Planner Boling stressed that what the <br />Board is being asked to waive are the basic provisions of the <br />ordinance itself. <br />The Chairman commented that from what we have heard it seems <br />there are hundreds of owners involved, but looking at the plat we <br />have, it looks like only ten or twelve. <br />Chief Planner Boling explained that the diagram shown <br />actually is just a portion of Vero Beach Suburban Acres. There <br />are probably 80 parcels altogether if the bank has the contracts <br />for all of it, and the bank is the majority land holder. <br />The Chairman felt as such the bank would have a significant <br />interest in moving this forward. Planner Boling agreed, but <br />advised .that staff tried working with them and were unable to get. <br />the addresses of all the people they had contracted with. <br />Commissioner Bowman believed with. the problems of the road <br />system, drainage, plus everything just discussed, it would seem <br />we are just opening a can of worms and she did not see how we can <br />allow this to go any farther than it already has. <br />28 <br />MAR 2 1988 <br />BOCK 71 PACE 385 <br />
