LOCATION & DESCRIPTION: <br />Hiram Manning, on behalf of Jeanne and William Haggas)has submit- <br />ted a petition for the abandonment of that portion of Azalea Lane <br />west of the west right-of-way of Frangipani Drive in Oceanaire <br />Heights. <br />This portion of right-of-way is bordered on two sides by lots in <br />Oceanaire Heights and dead -ends into the Kennedy Groves property. <br />The purpose of this abandonment is to provide for more developable <br />area for the lots bordering the right-of-way. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County division and utility <br />providers having jurisdiction within the right-of-way. All <br />agencies have completed their review of the proposed abandonment. <br />The traffic engineer has stated that the request should be denied <br />since,in accordance with Section 10(3) of the subdivision ordi- <br />nance, the stub -out of Azalea Lane is needed to provide future <br />access via a street extension to undeveloped properties to the <br />west. Planning staff also objects to the request for similar <br />reasons: extension of the right-of-way will be needed in the <br />future to extend roadway, drainage, and utilities systems. <br />Although this portion of Azalea is presently unused and is not a <br />part of the roadway system as noted on the County Thoroughfare <br />Plan, the right-of-way does provide for future connection to the <br />undeveloped lands to the west. <br />RECOMMENDATION: <br />Staff recommends that the County not abandon its rights to this, <br />portion of Azalea Lane, and that Chairman of the Board of County <br />Commissioners not be authorized to execute the attached resolution <br />(Attachment #3) . <br />Chairman Scurlock opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. <br />Attorney Hiram Manning presented his clients' petition for <br />the abandonment of the stub -out of Azalea Lane, which consists of <br />approximately 130 ft. He noted that the petitioners feel it is a <br />reasonable request since 1) the roadway is not in any present <br />use; 2) the lands owned at present by Kennedy Groves have been <br />zoned back to agricultural status, and 3) there would be access <br />to CR -5I0 through Jungle Trail and any cuts into that road. In <br />addition, if any east -west connectors are desired from <br />subdivision to subdivision, they can use Magnolia Lane to the <br />north and Cocoa Palm Lane, which is a through road from AIA. <br />Attorney Manning stressed that it is not a short street; it runs <br />APR 5 1988 <br />9 <br />BOOK 71 [Au 426 <br />
