TO <br />-Mr. Charles Balczun <br />County Administrator <br />DATE: April 5, 1988 <br />THRU: Robert Keating, AICPkOL- <br />SUBJECT: <br />Community Development <br />Director <br />FROM: Ester Rymer / <br />Building Dire <br />0 <br />FILE: <br />Condemnation of Unsafe. <br />Structure located at <br />920 20th Avenue, Vero Beach <br />REFERENCES: <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 19, 1988. <br />DESCRIPTIONS AND CONDITIONS: <br />Subject structure has been condemned and ordered repaired or removed. <br />Structure suffered severe fire damage on January 23, 1988. I. have <br />received numerous complaints from the surrounding property owners. <br />Said structure is considered unsafe and detrimental to the health, <br />safety, and welfare of the general public. Unfortunately, the owner <br />died as a result of injuries sustained in the fire. <br />RECOMMENDATION <br />I request the Board of County Commissioners declare said structure a <br />nuisance, and order the building demolished by the County Road and <br />Bridge Department if men and equipment are available. <br />After removal, in accordance with Section 4-21, Code of Ordinances, <br />Indian River County, the Board will cause a lien to be filed of <br />record for the costs of removal against the owner or person in <br />charge. <br />Commissioner Bowman asked if there were any heirs to the <br />property, and Building Director Ester Rymer explained that she <br />did not know, and that is the reason Attorney Collins advised her <br />to place the notice in the newspaper. <br />Attorney Vitunac advised that we are covered with respect to <br />the heirs and assignees. We advertised as required by law, and <br />if any heirs do show up, they have had constructive notice. <br />APP 19 1988 <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, the Board unanimously approved <br />staff recommendation as set out in the above memo. <br />18 <br />aaC! 72 PAGE 99 <br />
