After all the comments from DCA have been received, the Board of <br />County Commissioners will schedule a final public hearing to <br />consider the proposed amendments. At the close of these final <br />hearings, the Board may adopt all, part of, or none of the <br />proposed amendments to the Comprehensive Plan. The attached flow <br />chart illustrates the Comprehensive Plan Amendment process as <br />amended by the 1986 state planning legislation. <br />It is necessary for the Board of County Commissioners to vote on <br />each of the Comprehensive Plan amendment applications in order to <br />authorize transmittal of the applications to the State for <br />review. Three affirmative votes are required to authorize <br />transmittal. Further, it is necessary for the Board to state <br />their intent to hold a second public hearing concerning those <br />amendment requests authorized for transmittal. <br />ALTERNATIVES & ANALYSIS <br />The Planning Department feels that the best way to authorize the <br />transmittal of the proposed Comprehensive Plan amendments to the <br />State for review is through 'the passage of a resolution <br />authorizing the transmittal. Since a second public hearing must <br />be held prior to action being taken on each of the amendment <br />applications, no final decision can be made on the applications <br />at this time. However, action is needed on the attached <br />resolution in order to comply with the plan amendment procedure. <br />RECOMMENDATION <br />Based on the above analysis, staff recommends approval of the <br />attached transmittal resolution. <br />Director Keating advised that this is just an informational <br />item explaining the process where we only accept such amendments <br />twice a year. We are now considering amendments that were <br />accepted in January and the hearing today is simply a considera- <br />tion of whether or not the Commission wants to transmit these to <br />the state for the required 90 -day review. No action for <br />approval can be taken; although, action for denial could. <br />Chairman Scurlock reaffirmed to those present that no final <br />decision can be reached today. <br />Director Keating further noted that the proposed Resolution <br />authorizing transmittal should not be adopted until after all <br />the submittals listed have been decided on, except #4, Stenger et <br />al, which has been withdrawn. <br />12 Boor` 72 ME 171 <br />SPR 26 1988 <br />
