sending notification to the property owners 30 days in advance, <br />and he was informed that this letter was sent on March 22nd to <br />Vista Properties of Vero Beach, Inc. He further stated that on <br />April 19th a letter also was sent by Planning to Vista Properties <br />notifying them of the public hearing and transmitting to them a <br />copy of the agenda item before the Board. <br />Chairman Scurlock asked if we have any kind of receipt <br />indicating the letter was received, and Planner Nearing stated <br />the letter they sent did not normally call for a return receipt. <br />The Chairman asked Attorney Vitunac if it would be <br />reasonable to assume that knowledge of the public hearing is <br />evidenced by the fact that Mr. O'Haire and his people are here. <br />Attorney Vitunac confirmed that it would to a point. He <br />would have had to have reasonable notice; in other words, a 30 <br />day notice so that he would have had time to prepare. Attorney <br />Vitunac asked the Clerk to the Board if their office actually did <br />mail that letter. <br />Deputy Clerk Hargreaves confirmed that the required letter <br />of notice was put in the mail by the staff of the Office of Clerk <br />to the Board, and Attorney Vitunac noted that the law says that <br />once we put it in the mail, we have effected our notice and the <br />publication in the paper is the additional back-up notice. <br />Attorney O'Haire submitted for the record an affidavit to <br />the Clerk bearing a copy of the letter dated April 19th and a <br />copy of the envelope which was mailed bearing postmark of April <br />21st, and he asked that the record show that today is the 26th. <br />The letter was received according to the affidavit on the 22nd. <br />The 23rd was a Saturday - the 24th was a Sunday; so, there has <br />been only one working day of notice.
