Pr" <br />MAY p d 1988 <br />aa� :344 <br />LOCATION AND DESCRIPTION: <br />Jason and Opel Clemons have submitted.a petition for the abandon- <br />ment of all of that portion of*Berry Avenue (now known as 82nd <br />Court) between Gibson Street (now known as 130th Street) and <br />Roseland Street (now known as 133rd Street). <br />The subject right-of-way is bordered on two sides by lots in the <br />Townsite Plat of Roseland Subdivision and would provide a con- <br />nection between 130th Street and 133rd Street, if developed. The <br />purpose of this abandonment is to provide for more developable <br />area for the lots bordering the right-of-way. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way. All <br />agencies have completed their review of the proposed abandonment. <br />The traffic engineer and utilities department have both objected <br />to the abandonment of this right-of-way. The traffic engineer <br />stated that this portion ofright-of-way should not be abandoned <br />unless Roseland Street (133rd Street) is concurrently abandoned, <br />which is not the case. The Utilities Department has plans to <br />locate improvements in the subject right-of-way and the 133rd <br />Street right-of-way. <br />Although this portion of Berry Avenue (82nd Court) is presently <br />unused and is not a part of the roadway system as noted on the <br />County's Thoroughfare Plan, the right-of-way does provide for a <br />future access connection and convenient utilities extensions. <br />RECOMMENDATION: <br />Staff recommends that the County not abandon its rights to this <br />portion of Berry Avenue (82nd Court), and that the Chairman of the <br />Board of County Commissioners not be authorized to execute the <br />attached resolution (Attachment #3). <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wishedtobe heard in this matter. There being none, he <br />closed the Public Hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, the Board unanimously denied <br />the Clemons' petitionfor right-of-way abandonment <br />of a portion of 82nd Court (Berry Avenue), as <br />recommended by staff. <br />12 <br />
