r- <br />MAY 1 7 1988 <br />BOOK 72 F� `f 346 <br />LOCATION & DESCRIPTION: <br />Randy Pensch and Melba Mullins have submitted a petition for the <br />abandonment of 89th Court south' of 22nd Street. Per guidelines <br />established by the Board of County Commissioners,the petition was <br />reviewed by all County divisions and utility providers having <br />jurisdiction within the right-of-way. All reviewing agencies have <br />recommended approval of the abandonment, with the provision that a <br />15' .utilities and drainage easement be retained. The easement <br />will begin at the easterly edge of the existing ROW and will <br />provide access to existing Southern Bell cables. This portion. of <br />89th Court is not part of the roadway system as noted on the <br />County Thoroughfare Plan, and is not needed for the thoroughfare <br />system. <br />The stated reason for this abandonment is to gain additional <br />developable property for the abutting lots. While 89th Court <br />provides for connection to undeveloped property, the property is <br />currently zoned commercial. The .Comprehensive Plan discourages <br />the co -mingling residential and commercial traffic. Thus, <br />granting the request would ensure that such comingling of traffic <br />could not take place via 89th Court. <br />RECOMMENDATION: <br />Staff recommendsthat the County abandon its rights to this <br />portion of 89th Court, and that the Chairman of the Board of <br />County Commissioners be authorized to execute the attached <br />Resolution (Attachment #3), with the condition: <br />1. that a 15' utility easement be retained as described in <br />Exhibit A of the attached Resolution. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. There being none, he <br />closed the Public Hearing. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Eggert, the Board unanimously adopted <br />Resolution 88-34, providing for the closing, <br />abandonment and vacation of all of that portion of <br />120th Avenue (now known as 89th Court) between 22nd <br />Street and Tract 5 in Paradise Park Unit #2. <br />14 <br />
