However, with a subdivision <br />you have the ability to bond out required improvements and get <br />your site plan early. <br />Commissioner Eggert emphasized other developers are in the <br />business of restoration to begin with, although the environ- <br />mentalists might not agree, but there is destruction involved in <br />mining before the actual restoration begins. <br />Chairman Scurlock preferred to consider some performance <br />bonds for other developers, rather than remove the requirement <br />from mining operations, and Commissioner Eggert felt that would <br />be worth looking into. <br />Jim Gallagher of Sebastian objected to Section D in the <br />ordinance having to do with the restriction of hours of a mining <br />operation. He did not feel that mining operations should be <br />restricted on Saturdays. <br />Director Keating explained that the ordinance does not set <br />any restrictions for hours of operation for mines that are in <br />agricultural districts. It is in residential areas where the <br />hours of operation are specified; however, they can be modified <br />during the approval process by the Board of County Commissioners. <br />Chairman Scurlock understood then that they would have the <br />option to request operations on Saturdays and that the Commission <br />has the flexibility to allow it, but the Commission also has the <br />ability to stop it if there is a problem. <br />There being no others who wished to be heard, Chairman <br />Scurlock closed the Public Hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously adopted <br />Ordinance 88-21, repealing Section 25(r), Mining and <br />Excavation of the Code of Laws and Ordinances; and <br />creating a new Section 25 (r), providing for the <br />changes discussed above. <br />20 <br />
