<br />established by resolution of the Board of County Commis-
<br />sioners.
<br />(b) Permit renewal fees shall be one-half (I) the amount of
<br />the original fee.
<br />Violations and penalties. Violations of this article shall
<br />be punished as provided through forfeiture of the compliance
<br />bond in addition to general law. Any violation of this
<br />chapter is also subject to prosecution before the Indian
<br />River County Code Enforcement Board in accordance with
<br />applicable law and subject to penalties allowable under the
<br />code enforcement ordinance.
<br />PART 2
<br />Section 25.1(t), Earth moving uses, Appendix A, Zoning, of the
<br />County Code of Laws and Ordinances, is hereby amended as follows:
<br />(t) Extractive uses (Administrative Permit and Special Excep-
<br />tion) .
<br />(a) Districts Requiring Administrative Permit. Mining
<br />activities may be permitted within the A-1, Agricultural
<br />District upon receiving approval for an administrative
<br />permit as provided in Section 25.2 and after meeting the
<br />requirements defined below. -
<br />(b) Districts Requiring Special Exception. Mining activ-
<br />ities may be permitted within the RFD, RS -1, RS -2, RS -3,
<br />RS -6, RT -6, RM -3, RM -4, RM -6, RM -8, RM -10, RM -14, RMH-6,
<br />RMH-8, ROSE -4, CRVP, PRO, OCR, MED, CN, CL, CG, CH, IL,
<br />and IG districts upon receiving approval for a special
<br />exception as provided in Section 25.3 and after meeting
<br />the requirements defined below.
<br />(c) Criteria for mining operations:
<br />(1) A site plan meeting all requirements of Sections
<br />23.1 and 23.2 of the County Zoning Code.
<br />(2) A reclamation plan including littoral zone plan and
<br />water quality management plan, as applicable.
<br />(3) All mining activities must comply with Section
<br />25(r), Excavation and Fill, Appendix A, Zoning, of
<br />the County Code.
<br />(4) All mining operations in the PRO, OCR, MED, CN, CL,
<br />CG, CH, IL, and IG zoning districts shall be
<br />incidental to any Indian River County Development
<br />order or permit, including approved site plans,
<br />subdivision plats, final development plans and/or
<br />building permit.
<br />(5) All mining sites shall have direct access to a
<br />collector or arterial roadway; access from a
<br />roadway of lessor fuctional classification may be
<br />approved by the Public works Director upon a
<br />finding that no significant adverse impact will
<br />affect residential units on the subject road.
<br />(6) The site must not be located within 1,000 feet of
<br />any platted subdivision that is not serviced by
<br />public water.

<br />CODIFICATION
<br />The provisions of this ordinance shall be incorporated into the
<br />County Code and the word "ordinance" may be changed to "section",
