AUTHORIZATION TO AMEND ZONING CODE TO RESTRICT LOCATION OF BOTTLE <br />CLUBS AND ADULT BOOKSTORES <br />Administrator Balczun reviewed the following: <br />TO: Charles Balczun DATE: May 23, 1988 FILE: <br />County Administrator <br />AUTHORIZATION TO AMEND THE <br />SUBJECT: ZONING CODE TO RESTRICT THE <br />LOCATION OF BOTTLE CLUBS <br />AND ADULT BOOKSTORES <br />Robert M. Keating, AICPAlpfk <br />FROM: Director REFERENCES: bottc. /dw4 <br />Community Development Department <br />7t is requested that the information herein presented be given <br />formal consideration by the Board of County Commissioners at their <br />regular meeting of May 31, 1988. -_ <br />DESCRIPTION & CONDITIONS: <br />The staff has had several recent requests from commissioners to <br />prohibit or restrict the location of bottle clubs and adult <br />bookstores. Under present ordinances, bottle clubs are treated <br />similar to bars, yet no separation distance from churches and <br />schools is required because bottle clubs do not sell alcohol. <br />Adult bookstores are treated exactly.as other types of bookstores. <br />ALTERNATIVES & ANALYSIS: <br />With both bottle clubs and adult bookstores, prohibition of the <br />use may not be legal. However, it is possible to severely <br />restrict the location of these uses. For example, such uses may <br />be relegated to industrial areas with minimum separation distance <br />required from residential districts. <br />To restrict these uses, the planning staff will need to <br />extensively coordinate with the county attorney's office and draft <br />applicable ordinance amendments. These would then be reviewed by <br />the Planning & Zoning Commission, and final action would be taken <br />by the Board. In order to initiate this activity, the staff needs <br />the appropriate authorization. <br />RECOMMENDATION: <br />If the Board of County Commissioners wishes to pursue more <br />restrictive regulation of bottle clubs and adult bookstores, the <br />appropriate course of action would be to authorize staff to draft, <br />advertise, and process zoning code amendments' to restrict bottle <br />clubs and adult bookstores. - <br />Commissioner Eggert commented that she was told by a realtor <br />that the County doesn't have any restrictions and the City does. <br />She realized these things can't be prohibited, but she would at <br />53 BOOK 72 F'Au. 453 <br />l SAY 31 1988 I <br />
