TRANSFER OF ASSETS OF UTILITIES_ DEPARTMENT TO THE SOLID WASTE <br />DISPOSAL DISTRICT <br />County Attorney Vitunac reviewed the following <br />TO: Board of County Commissioners <br />FROM: Charles P. Vitunac, County Attorney <br />DATE: May 25, 1988 <br />RE: TRANSFER OF ASSETS OF U TILITIES DEPARTMENT <br />TO THE SOLID WASTE DISPOSAL DISTRICT <br />Commission Meeting - May 31, 1988 <br />In connection with the establishment of the Solid Waste <br />Disposal District, our bond counsel and financial <br />consultants have suggested that certain assets of the County <br />be transferred to the District, since it will be functioning <br />as a dependent special district and will not be using any <br />County funds. <br />The attached resolution transfers the physical assets of the <br />Utilities and Refuse Departments to the District and <br />authorizes future execution of bills of sale, leases, and <br />quitclaim deeds, as may be necessary. <br />Attorney Vitunac explained that this transfers assets used <br />by the County now for the solid waste system to the Solid Waste <br />District. It is a requirement of the bond officials that we <br />lease the property and all the equipment for $1.00 a year until <br />the bonds are paid off. The Resolution also defeases the old$1.8 <br />million bond issue, and it requires that to be done from the <br />proceeds of the$8.2 million bond issue. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bird, the Board unanimously (4-0) adopted <br />Resolution 88-37 transferring certain assets of the <br />Utilities Department to the Solid Waste Disposal <br />District and authorized the Chairman to execute the <br />Lease to the District. <br />87 <br />MAY 3 11988 BOOK. 72 2 P,, fx 492 <br />C <br />
