McCoItiA REFERENCES: <br />Staff Planner <br />FRANK PERONE'S REQUEST <br />FOR RIGHT-OF-WAY <br />ABANDONMENT OF A PORTION <br />OF 89TH DRIVE <br />perone r -o -w <br />JOHN2 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of June 7, 1988. <br />LOCATION & DESCRIPTION: <br />Frank Perone has submitted a petition for the abandonment of 89th <br />Drive south of 22nd Street. Per guidelines established by the <br />Board of County Commissioners, the petition was reviewed by all <br />County divisions and utility providers having jurisdiction within <br />the right-of-way. All reviewing agencies, except for the Public <br />Works Department, have recommended unconditional approval of the <br />abandonment. The Public Works Department has recommended approval <br />of the abandonment with the condition that a 20' utilities and <br />drainage easement be retained within the existing right-of-way. <br />The easement would be centered in the existing right-of-way and <br />would provide for future utilities and drainage installation and - <br />maintenance. This portion of 89th Drive is not part of the <br />_roadway system as noted on the County Thoroughfare Plan, and is <br />not needed for the thoroughfare system. <br />While 89th Drive provides for connection from 22nd Street to <br />undeveloped property, the subject right-of-way segment would <br />directly connect a commercially zoned area to a residential area. <br />The Comprehensive Plan discourages co -mingling residential and <br />commercial traffic. Thus, granting the request would ensure that <br />such comingling of traffic could not take place via 89th Drive. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to this <br />portion of 89th Drive, and that the Chairman of the Board of <br />County Commissioners be authorized to execute the attached <br />Resolution (Attachment #3), with the following condition: <br />1. that a 20' utility easement be retained as described in <br />the attached Resolution. <br />The Chairman opened the Public Hearing and asked if anyone <br />wished to be heard in this matter.
