Wiegers REFERENCES: <br />Staff Planner <br />r ,f) <br />oyster <br />BWIEG <br />bay <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of June 7, 1988. <br />DESCRIPTION & CONDITIONS: <br />Oyster Bay Subdivision is a proposed 34 lot subdivision of a ±24 <br />acre parcel located on the west side of SR A -1-A, south of <br />Seminole Shores Subdivision. Because the property has over 600 <br />feet of river shoreline, a public access easement running from SR <br />A -1-A to the river is required pursuant to Section 10(r) of the <br />subdivision ordinance. In lieu of actually providing such an <br />easement, the Board of County Commissioners may accept a monetary <br />dedication to the park development fund in an amount equal to the <br />fair market value of such an easement. <br />At its regular meeting of October 8, 1987, the Planning and Zoning - <br />Commission granted preliminary plat approval for Oyster Bay, <br />_subject to the condition that either the actual easement be <br />provided or a monetary dedication be offered that is acceptable to <br />the Board of County Commissioners. <br />The owner, Salama Development Corporation, is now requesting Board <br />approval to accept a $7,400.00 dedication to the park development <br />fund to satisfy the water access requirement of Section 10(r) of <br />the subdivision ordinance. <br />ANALYSIS: <br />In lieu of dedicating an improved access easement from SR A -1-A to <br />the river, the owners have agreed to dedicate $7,400.00 at the <br />time of the final plat approval. The $7,400.00 amount is based on <br />an Armfield-Wagner appraisal of the fair market value of the <br />required 15' wide improved access easement. The Property Apprais- <br />er's office has verified that the appraisal is a reasonable <br />estimate of the raw land value of the required easement . The <br />Public Works Department has verified that the cost estimate for an. <br />improved pedestrian walkway is reasonable. <br />Dedication of the appraisal value is adequate for satisfying the <br />public access requirement of Section 10(r) of the Subdivision <br />Ordinance, if accepted by the Board of County Commissioners. <br />7 <br />1JUN 1988 <br />ROOK 72 FACE 506 <br />
