Chairman Scurlock felt that is just wishful thinking since <br />at this point neither one of them has been willing to donate <br />anything as far as he has been told. <br />Assistant County Attorney William Collins informed the Board <br />that the last word he had from R/W Agent Finney was that we had <br />talked with Mrs. LaCava, who was in a position where she would be <br />willing to sell but did not settle on a price. Southgate's <br />trustee, Attorney Joe Collins, indicated they were not interested <br />In having a road that would go inside the boundaries of their <br />fence, but they would be willing to negotiate on 19' additional <br />R/W if it went outside north of their fence; however, no price <br />was discussed. This still would result in a 44' road rather than <br />our 50' standard. <br />Chairman Scurlock felt the logical thing to do, since we <br />have no assurance we can ever acquire the R/W at a reasonabl-e <br />price, would be to allow Mr. Faber to construct a paved driveway <br />into his property on the 25' R/W, and we will barricade it at the <br />eastern boundary of his property. <br />Commissioner Bird agreed as he believed it would be a bad <br />situation to bring that road through to intersect with U.S.1. in <br />any event. <br />Commissioner Wheeler felt the proposed solution might cause <br />Southgate to look at this more closely. <br />Commissioner Bird stated that he would like staff to pursue <br />this option with Mr. Faber and his attorney and bring this back <br />at a subsequent meeting. He asked if we need to get involved <br />with the City if we barricade their road. Discussion continued <br />as to whether we should be involved with this.matter or the City, <br />and it.was confirmed that the portion we are discussing is in the <br />county. <br />Administrator Balczun asked if the Board would like staff to <br />negotiate -a form of construction agreement with Faber.Press. <br />Commissioner Bowman noted that.still won't solve his water <br />JUL 1988 15 Boor `7 ,AG -155 <br />
