CONTRACT FOR SALE AND PURCHASE <br />THIS CONTRACT FOR SALE AND PURCHASE is made and entered into <br />this 5th day of July , 1988, by and between <br />ISABELLE M. BEUTTELL, hereinafter called the "Seller", and INDIAN <br />RIVER COUNTY, FLORIDA, a Florida political subdivision, herein- <br />after called the "Buyer". <br />WITNESSETH: <br />WHEREAS, the Seller is the owner of certain real property <br />located in Indian River County, Florida`, the same being more <br />particularly described in Exhibit A attached hereto and made a <br />part hereof; and, <br />WHEREAS, Buyer intends to condemn ;the above referenced <br />property in the event that no agreement is worked out between the <br />parties' hereto; ,and,. <br />WHEREAS, the Seller wishes to sell and the Buyer wishes to <br />buy said property under the terms and conditions hereinafter set <br />forth. <br />NOW, THEREFORE, for and• in consideration of the mutual <br />promises and covenants contained herein, as well as other good <br />and valuable consideration,. the receipt of which is hereby <br />acknowledged, the parties to.this contract do.agree as follows: <br />1. AGREEMENT TO BUY AND SELL; Seller agrees to sell and <br />Buyer agrees to buy that certain real property located in Indian <br />River County, Florida, more particularly described on Exhibit A <br />attached hereto and incorporated by reference herein, which <br />property is approximately 148.396 acres, including easements but <br />excluding rights of way. <br />2. LIENS AND ENCUMBRANCES: Seller warrants that there are <br />no'liens and/or encumbrances on the herein described property <br />except those appearing of record and taxes for the year 1988. <br />I. PURCHASE PRICE AND METHOD OF PAYMENT: <br />A. The purchase price for the property is <br />$1,720,000.00; however, said figure is derived from a <br />purchase price of $11,500.00 per acre.
