DATE:July 18, 1988 FILE: <br />County Administrator <br />DIVISION HEAD CONCURRENCE: APPEAL OF THE PLANNING AND <br />ZONING COMMISSION'S DENIAL <br />OF THE <br />Robert M Kea in , A <br />SUBJECTNIT TO <br />ODIFY AOCONDITIONORINGS QOFSSITE <br />Community Devel pme Director PLAN APPROVAL <br />FROM: Stan Boling d' REFERENCES: moorings <br />Chief, Current Development _ BWIEG <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of July 26, 1988. <br />DESCRIPTION AND CONDITIONS: <br />Lloyd & Associates, Inc. has submitted an administrative approval <br />on behalf of the Moorings Center, Inc., to modify a condition of <br />site plan approval. <br />At its regular meeting of March 24, 1988, the Planning and Zoning <br />Commission granted major site plan approval to construct a 53,200 <br />sq. ft. shopping center at 2100 Windward Way, The Moorings. At <br />the time this plan was approved by the Planning and Zoning Commis- <br />sion, the plan showed a 10' right-of-way dedication along this <br />site's S.R. A -1-A frontage. In addition, a condition was attached <br />to site plan approval that the developers dedicate this 10' strip <br />to the County prior to release of the approved plans. The plan <br />also showed an 8' bikepath within the 10' right-of-way strip as <br />required by Section 19(L) and 23.3(e)(6) of the County Code. <br />The applicant has requested that the condition relating to the <br />dedication of the 10' strip be deleted from the original Planning <br />and Zoning Commission approval and that the plan be further <br />modified to delete the required 8' bikepath. <br />At its regular meeting of July 14, 1988, the Planning and Zoning <br />Commission considered the modification, and unanimously (4-0) <br />voted to: <br />1. Grant the developer the option to escrow funds for the <br />required S.R. A -1-A bikepath prior to issuance of a <br />certificate of occupancy (C.O.); <br />2. Deny the request to delete from the site plan the 10' dedi- <br />cation or reservtion strip along the site's S.R. A -1-A <br />frontage, since the request does not conform to existing <br />regulations; <br />3. Recommend that the Board of County Commissioners direct staff <br />to: <br />a, suspend application of the existing road reservation <br />requirement to the Moorings Center project, <br />b. revise existing requirements, and <br />C* approve the modification. <br />12 BOOK 73 Pd GF 25® <br />JUIL 2 6 1988 <br />
