Administrator Balczun clarified his position in that he is <br />not suggesting that the Board not authorize a third -party hearing <br />officer; it is just that he also needs some advice on the matter. <br />He suggested that the Board proceed to authorize the third -party <br />hearing officer in the event Attorney McDonough agrees to it. <br />COMMISSIONER EGGERT REINSTATED HER MOTION, AND COMMISSIONER <br />WHEELER WITHDREW HIS SECOND. <br />COMMISSIONER BOWMAN SECONDED THE MOTION INSTEAD. <br />Further discussion ensued on Administrator Balczun's <br />position of supporting a third -party hearing officer. <br />Chairman Scurlock stated he was incorrect in what he had <br />understood Administrator Balczun was saying, and that he would <br />support the third party hearing officer if he understood it <br />clearly that Administrator Balczun was in favor of it. <br />Commissioner Wheeler felt that ultimately a judge would be <br />hearing this as the third party., and he would live with that and <br />save the money of hiring the outside person. <br />THE CHAIRMAN CALLED FOR THE QUESTION. By a vote of <br />3-1, Commissioner Wheeler dissenting, the Board <br />approved the hiring of an independent third -party <br />hearing officer for the hearing of Mary Kiser. <br />Commissioner Eggert requested that Attorney Vitunac bring <br />back some idea of the costs before the Board approves a budget <br />transfer. <br />P <br />Commissioner expressed her desire to have a judge as the <br />third party, and Chairman Scurlock suggested retired Judge Smith <br />as a possibility. <br />Attorney Vitunac felt that there are a lot of local <br />attorneys or jurists who could approach this impartially. <br />MCI' 2 1988 34 gQa 73 r'.
