� � r <br />locally and find a hearing officer who could step away from all <br />of it and say what his opinion is. <br />Commissioner Bird asked what the next step would be accord - <br />Ing to our personnel policy and procedures, and Commissioner <br />Eggert noted that Mr. Balczun was going to do the hearing, but he <br />is in a way a witness; therefore, it seemed to her that if we had <br />a designee who was not in any way involved, we could get <br />something that might be satisfactory to everyone. <br />Commissioner Bird noted that Mrs. Kiser is then entitled to <br />a hearing before the Administrator prior to final hearing which <br />would be before this Board, and Attorney Vitunac pointed out that <br />it is Mr. Balczun's designee and it is really up to Mr. Balczun <br />to approve this designee for it to be his hearing. It does not <br />have to be a person totally divorced from Indian River County or <br />even with knowledge of the case. In this case he is taking <br />himself out because of his unique involvement with it. Normally <br />it would be he. <br />Commissioner Bird felt then the Administrator needs to be <br />involved in the process as to who his designee is. He commented <br />that he made a suggestion to the Administrator about the <br />possibility of using a retired local judge for the hearing <br />officer - possibly Judge D.C.Smith. <br />Chairman Scurlock stated that as he read the desire of the <br />Commission, it was to get someone independent who is not so close <br />to this situation or involved just to look at the documentation <br />we have at this point and act as a buffer and make some sort of <br />recommendation. He noted that going to the National Labor <br />Relations people is a lengthy process, and personally he would <br />like this to be handled in a more timely fashion, if possible. <br />Commissioner Bird agreed that he would hate to delay this <br />another week; we have an employee out there suspended with pay as <br />he understood it, and he would like to get this matter resolved <br />and move on. - <br />L- 41 <br />BOOK 73 F.�CE 392AUG 9 19 <br />
