ADAMS <br />This letter is to confirm our telephone conversation <br />regarding Mr. Balczun. As we discussed, it is Mr. Balczun's <br />position that his contract was wrongfully terminated and that he <br />is entitled to be paid his regular salary plus benefits through <br />September, 1989, plus additional payments required by the <br />contract. Please consider this a demand for those payments. <br />Would you kindly advise me as to the legal position that <br />Indian River County is going to take in this matter. The purpose <br />of my telephoning you was to discuss the matter informally with <br />you and to see if the matter could be resolved without the° <br />necessity of litigation. During the course of our conversation, <br />you indicated that you do not have the authority to respond to <br />settlement negotiations. Accordingly, would you please present <br />this proposal and advise me of the official position of the <br />County. <br />In addition, during our telephone conversation, you <br />suggested that the County might now try to go back and fire <br />Mr. Balczun for cause. On behalf of our client, we would object <br />vehemently to any retroactive action. Obviously, such action <br />would be extremely harmful and detrimental to our client. The <br />mere fact that it is being suggested after the fact is an <br />indication of bad faith. Accordingly, I respectfully request <br />that the County not take such derogatory action. <br />If you need any additional information in order to properly <br />analyze this request, please do not hesitate to contact me. As <br />stated in my prior letters, Mr. Balczun will not negotiate or <br />speak directly with anyone from the County regarding this matter. <br />All communication should be handled through our firm. <br />Sincerel <br />Ladd H.
