Chairman Scurlock believed staff basically is talking about <br />bisecting the property north to south, and Commissioner Eggert <br />felt the CL zoning for the 400' depth would conform to the <br />commercial plaza to the south and asked if it would allow <br />something similar to the Vero Mall. <br />Staff Planner Nearing confirmed that the Vero Mall is <br />approximately 10 acres and Ryanwood Shopping Center is 101 to 11 <br />acres. <br />The Chairman asked if anyone present wished to be heard. <br />Attorney Michael O'Haire came before the Board on behalf of <br />Vista Properties, Inc., the owners of the entire tract in <br />question, and asked that the Board deny the appeal made by staff. <br />He noted, however, that he had understood staff's recommendation <br />would be RM -10 rather than the RM -6 which was just mentioned by <br />Mr. Nearing. <br />Staff Planner Nearing confirmed he had meant to say RM -10. <br />Attorney O'Haire stressed the property's history of commer- <br />cial zoning. noting that this rezoning was occasioned by an <br />application for site plan approval, which application is <br />currently in litigation, and another site plan has been filed for <br />approval because while this was taking place, the Board amended <br />the site plan ordinance to erase a problem that occurred during <br />the first site plan application. Mr. O'Haire pointed out that <br />this property is at the intersection of two arterials, and it <br />conforms in every respect with the policy of this Board in <br />locating commercial nodes at the intersection of major arterials. <br />The Board has not addressed commercial development in the sense <br />of strips along a thoroughfare. This property is surrounded by <br />commercial uses on three sides, and the use of this property for <br />residential is not going to solve the traffic problems that <br />commercial development would solve. The last developer who <br />proposed development of the entire tract committed to over <br />$200,000 of offsite traffic improvements, but to justify that <br />SEP 6 1988 39 wa, 74 u1,JE 9' <br />
