Attorney Bruce Barkett came before the Board representing <br />the Vista Civic Association and asked that everyone present from <br />Vista Civic and the Property Owners Association, who is <br />interested in this issue raise their hands. A hundred or so <br />people raised their hands. Mr. Barkett believed the statements <br />regarding this property being zoned commercial since 1969 hides <br />the fact that the Comprehensive Plan was amended in 1982 to <br />downzone this to residential, and then against the Planning <br />Department's recommendation and based on the owner's representa- <br />tions, the Board in 1983 redesignated it in the Comp Plan to <br />commercial use because the owner said he would build something <br />like the Village Shops- Mr. O'Haire now says the owner had a <br />change of heart and can't do that, and that was the Board's only <br />grounds for changing the Comp Plan in 1983. Mr. Barkett <br />supported the staff's recommendation to change the Land Use <br />designation for the eastern portion of the property to <br />residential and reduce the commercial portion; although he agreed <br />with Attorney Lloyd that it is no.t the best solution. He <br />believed the OCR suggested by Commissioner Bowman is the best <br />solution because it would avoid a lot of the co -mingling of <br />residential and commercial traffic and also would preserve the <br />trees and the entrance to Vista Gardens. <br />Chairman Scurlock asked the County Attorney if it is <br />possible to consider OCR for the commercial portion of the <br />property at this meeting. <br />Attorney Vitunac did not believe that is properly before the <br />Board today and that it would have to be readvertised for OCR and <br />have another hearing. <br />Attorney Barkett wished to know why, if the Board is saying <br />they could zone the whole parcel residential or keep 1/2 residen- <br />tial and half commercial, they could not go to half residential <br />and half something less than commercial, which is OCR. <br />Discussion continued regarding the language in the ad, and <br />Acting Administrator Collins did not believe we can consider <br />42 <br />BOa7 P'.{rye <br />
