This is <br />not the same as a similar amendment request for vacant property. <br />Second, the 150 feet of additional MXD depth for this portion of <br />the district is not a major encroachment into a residential area, <br />and it only includes that portion of the overall 5.6 acre parcel <br />which has been operating as a business for at least 10 years. <br />Third, the 1.11 acres involved in this request is not a <br />substantial increase in land with an MXD designation. <br />Transportation System <br />The site currently has access to 12th Avenue S.W. designated as a <br />local road on the County's Thoroughfare Plan. The increase of <br />1.11 acres of land zoned CH will not have any substantial impact <br />on the current traffic situation. <br />Environment <br />The site is not designated as environmentally sensitive, nor is <br />it located in a flood prone area. <br />Utilities <br />Public water facilities are currently available to this area to <br />the south along Oslo Road. <br />Conclusion <br />Staff feels that, because this property has been in its current <br />use for at least ten years, this: request is not really an <br />expansion of the MXD land use, but more of a clarification and <br />correction of the actual land use for this property. Further, <br />its dimensions and size are not a substantial increase in this <br />MXD area and will not encourage or legitamize additional similar <br />requests. This land use/zoning amendment should not have any <br />substantial adverse impacts on this area and is consistent with <br />the area's development. <br />RECOMMENDATION <br />Based on the analysis performed and the lack of opposition by the <br />DCA, staff recommends that the Board of County Commissioners <br />approve this request to change the land use designation from LD -2 <br />to MXD for 1.11 acres, and approve the request for rezoning from <br />RS -6 to CH. <br />ON MOTION by Commissioner Bowman, SECONDED by Commis- <br />sioner Eggert, the Board unanimously (4-0) approved the <br />change of Land Use designation to MXD for the 1.11 acres <br />and the rezoning to CH as requested by Richard 6 Arly ne <br />Zorc.
